Election Law Keeps Immigration Agents Off Michigan Polls

LANSING, Mich. — Online rumors about Immigration and Customs Enforcement agents watching Michigan voting sites collide with limits written into federal and state election law as early voting continues.

Federal rules generally keep armed federal officers away from polling places unless they are called in to stop armed civil unrest. Michigan law goes further for every police agency: officers may not hang around or run enforcement work inside polling rooms unless a clerk calls them in during an emergency.

Local clerks and precinct inspectors control each site and enforce a 100-foot buffer. Electioneering is off-limits inside the room, at early-vote centers, and for the first 100 feet outside any entrance. Voting is limited to registered U.S. citizens, and intimidating voters is already a crime.

Homeland Security dropped an internal sensitive-locations memo in January 2025 that had kept ICE away from places such as polls, but the current administration has said it does not plan to send immigration agents to voting sites. Even without that internal memo, the statutory bans remain.

Election officials say voters who see someone filming or pressuring people near a precinct should contact the clerk or precinct chair rather than confront them. Emergency police response is still available when a clerk asks for help.
